AssessMilesLog - Privacy Policy (release 1, early access)

Status: DRAFT for solicitor review. Machine-drafted by Counsel. Not reviewed by a qualified solicitor. Written for RELEASE 1 ONLY: the free early-access app with no server, no account, no sign-in, no billing and no waitlist, and no internet permission (Anton, via Marveen msg 14840; Director, candidate f31e820). Release 2, which adds a server, has its own text (the v2 policy). Do not publish either as final. Every bracket marked CONFIRM is a fact Counsel was not given. 1. The short version

AssessMilesLog keeps your driving records, statements, receipts, vehicle details and estimates only on your phone. There is no AssessMilesLog account and no AssessMilesLog server in this version, and the App has no permission to use the internet. We do not receive a copy of your data. Three things can leave your phone, and only if you choose them: a backup, locked with your passphrase; exports for your accountant; and a feedback email you send to us. You choose where the backup and the exports go. The feedback email goes to us, at contact@seekresolve.co.uk. If you email us, we receive your email. Read on for the detail; do not rely on this summary alone.

2. What the App keeps, and where

2.1 On your phone only

  • Your shifts and GPS points, while a shift is recording, and for 12 months afterwards, then automatically deleted.
  • Per-shift mileage summaries (categories, timings, and a coarse area, not exact coordinates), kept for 6 years, then automatically deleted.
  • For each shift, which of your vehicles you used, and a tag, "private hire" or "delivery", set from your driver type. You can change the tag. They are kept with the shift summary.
  • Uber statement PDFs you import, and the figures read from them. (Importing statements is a Pro feature, free during early access.)
  • Receipt photos you take, and the figures read from them. (Scanning receipts is a Pro feature, free during early access. You can type an expense in by hand.)
  • Your tax-year estimates. The automatic estimate, worked out from your statements, is a Pro feature, free during early access.
  • The figures you enter in the tax calculator for each tax year (for example your earnings, vehicle type, business miles, running costs, business-use share and other costs), some of which the App fills in for you from your own records and you can change, and the estimate worked out from them. They stay on your phone, are included in your backup and your CSV export, and you can clear them in the calculator.
  • The type of driver you say you are (for example car, or bike and e-bike courier), which the App uses to apply its free limits. You choose it, and the App does not check it.
  • Your home location. When you start your first shift the App asks "Is this your home?". It asks once, on your first shift, and never sets your home without your answer. If you say yes, it saves your phone's last known location as home, so only say yes if you are at home right now. If you say "Not now" it saves nothing and does not ask again. You can set or change your home in Settings at any time.
  • For each vehicle you add: its registration number and odometer readings, if you type them in, and, if you want reminders, the dates your MOT, vehicle tax, private hire vehicle licence (the plate) and driver badge expire. Your registration number goes into an export only if you tick it. The App does not look anything up with the DVLA or any other service.

All of this is encrypted on your phone. The key is held in your phone's own secure storage (Android Keystore), not by us. If you make a backup, the backup also contains this key, locked with your passphrase (see "Backups and exports").

2.2 Financial records are kept longer, and are not auto-deleted

Statements, expenses and receipt photos are kept for at least 6 years, in line with standard record-keeping expectations for tax purposes, and are never automatically deleted. After 6 years, the App offers you the option to delete a tax year's records, with an explicit confirmation step; it does not delete them on its own. "Delete all my data" in Settings removes everything the App holds, including your vehicle details. Backups and exports you have already saved somewhere else are not deleted by this: they are files you hold, and you can delete them yourself.

2.3 What we receive

Nothing from the App on its own. We have no server for it, it has no account, and it cannot reach the internet. If you press Send feedback, the App opens your own email app with a message to contact@seekresolve.co.uk that already shows your phone's make and model, the Android version and the AssessMilesLog version. Nothing is sent unless you press Send in your email app, and you can read, change or delete anything in the message first. If you do send it, we receive your email address, what you write and those details; your email provider handles the message on its way, under its own rules. The same applies if you write to us for support, or with a request about your data: we receive your email address and what you tell us. We keep a support or feedback conversation for 12 months after the last message and then delete it. We use feedback only to reply and to find and fix problems. Please do not email us screenshots that show your records unless you want us to see them.

3. What the App asks your phone for, and why

  • Location, "While using the app". The App records your location only during a shift. A shift starts only when you tap "Start shift"; nothing else starts recording, not opening the App, not restarting your phone, not another app. A shift ends when you tap "Stop shift". When you have been still for 10 minutes within 150 metres of your home location, the App asks "Stop work?". If you tap Stop, the shift ends at the time you arrived. If you tap "Not yet", it does not ask again for that stay. If you do not answer for 10 more minutes, the shift ends at your arrival time and is marked for you to check. Until you have set a home location, this question is not asked. A shift also ends if you have been still for 2 hours anywhere. While a shift is recording, the App shows a notification so you can see it, and it keeps recording when your screen is off or you switch to another app. If you choose "Break / private", the App keeps recording your location so no mileage is lost, stores it on your phone, and marks that time as private (personal) miles until you tap Resume work. Your location is stored only on your phone. The App does not ask for "Allow all the time" location.
  • Camera. The App does not ask for camera permission. It opens your phone's own camera app to take a receipt photo.
  • Notifications, which the App uses for five things: to show that a shift is recording; to ask "Stop work?" when you have been still at home; to remind you about missing receipts and tax deadlines; to nudge you when no mileage has been logged for a number of days ("No mileage logged for 3 days", for example, which holds only the number of days and nothing about where you went); and to remind you before the MOT, vehicle tax, private hire vehicle licence or driver badge date you typed in. Reminders are limited to one a day and three a week, counted together; the last reminder before a date you typed in is always sent, even over that limit, and a reminder held back is tried again the next day. A reminder about a date shows only "A vehicle date is coming up. Open AssessMilesLog to see it." on your lock screen, unless you turn on "Show details in reminders" in the App's Settings, which shows the registration number and the date. If you have turned on the app lock, the reminder is always generic. You can turn each kind off in your phone's settings.
  • Biometric (fingerprint, face or PIN), only if you turn on "Lock the app" in Settings. It is off unless you turn it on. Your phone does the check and tells the App only "unlocked" or "not". The App never receives or stores your fingerprint, face or PIN, and has no PIN of its own.
  • Run at start-up. The App only reschedules reminders when your phone restarts. It never starts recording because the phone started.
  • Keeping your phone awake for a short time, so a reminder or a task can finish, and checking whether your phone has a network connection. Both come with software libraries the App uses. Neither lets the App send or receive anything: the App has no permission to use the internet.

You can turn any of these off in your phone's settings. Without location, the App cannot record mileage automatically. The App does not read which other apps you use, and does not ask for access to do so. Send feedback needs no permission: it opens your own email app with a message already written, and the App sends nothing itself. Some phones have their own battery savers, which can stop an app recording while the screen is off. If a shift stops recording, check your phone's battery settings for AssessMilesLog.

Receipts are read on your phone, by text-recognition software that is part of the App. Nothing is downloaded to do it, and the App has no permission to use the internet. The photo and the text read from it are not sent to Google, to us, or to anyone else.

4. Backups and exports: you choose where they go

If you choose to back up, the App encrypts your data on your phone, using a key made from a passphrase only you know, before it is saved or shared. You choose where it goes: it can be saved as a file or sent through your phone's share sheet to any place or app you pick, for example your own Google Drive. We never receive the backup, never see your passphrase, and cannot decrypt it. Only you can restore it. The backup also contains the key to your records, locked with your passphrase. That makes your passphrase the only protection on the backup file: anyone who gets the file and can guess your passphrase can read your records. Choose a long passphrase that is hard to guess; the App asks for at least 12 characters. A backup lets you restore your records on a new phone or after you reinstall the App. Once you send it somewhere, that place's own rules apply to it, not ours.

If you forget your passphrase, nobody can recover the backup, including us. The App warns you about this when you set up a backup.

The spreadsheet (CSV) export for your accountant is not locked with a passphrase. It contains your figures. You send them where you choose, and what happens to them after that is up to you and whoever receives them.

5. Other organisations

No organisation receives your records from the App. The App has no analytics, advertising or crash-reporting software and no permission to use the internet. If you want to report a crash, you export a local log yourself and send it. The Send feedback button only opens your own email app; it sends nothing itself. Google Play (or the app store you used) knows that you installed the App, under its own policy, not ours.

Uber is not a recipient of any data. The App reads statement PDFs you choose to import. It does not connect to Uber or sign in to your Uber account.

6. Other people's data

The monthly Uber statements the App supports contain only your own earnings and mileage totals. They do not name passengers. The App does not import Uber's personal-data download, which contains passenger addresses. If a receipt shows another person's name, the App reads only the total, VAT, date and merchant fields, and stores no other free text.

Weekly Uber statements are not supported and have not been reviewed for passenger or trip detail.

7. Your rights

Because your records are stored only on your own phone and we hold no copy, they are already in your hands. You can view, change or delete anything in the App, or delete the App to remove everything on the phone. For anything we hold about you, such as a support email, you can ask us for a copy, to correct it, to delete it, or to stop using it. Write to privacy@seekresolve.co.uk. To protect your data, we send a copy only to the email address that the emails we hold came from, and we release nothing to anyone who writes from a different address.

You can complain to the UK Information Commissioner's Office (ico.org.uk) if you think your data has been mishandled.

8. Children

The App is for adult drivers and is not directed at children. You must be at least 18 years old to use the App.

9. Changes to this policy

Later versions of the App may add an account and a server, for example to sell a subscription. If that happens, we will update this page before it ships and show the change in the App before you use it. The date of the last update is at the top of the page.

11. Visiting assessmileslog.com

This section is about the website, not the App. The website sets no cookies, uses no analytics or advertising tools, and has no forms or accounts. [CONFIRM after the fonts and scripts are checked: the page loads nothing from other companies' servers, because the fonts and images are served from the site itself.]

  • The web server records the page requested, the time and a shortened form of your IP address, and keeps this for 14 days to keep the site secure and working. [CONFIRM the server's logging matches: shortened addresses, 14 days.] Our legal basis is our legitimate interest in running a secure site.
  • The tools on the site work in your browser. What you type into them is not sent to us. [CONFIRM by test.]
  • If you email contact@seekresolve.co.uk or privacy@seekresolve.co.uk, we receive your email address and what you write. We keep the conversation for 12 months after the last message and then delete it. We use it only to answer you.
  • Links to other sites, such as gov.uk and Google Play, take you to places with their own privacy policies. We cannot see what you do there.
